Information on data processing pursuant to Articles 13 and 14 DSGVO
– Data processing of customers (B2B) –

We hereby inform you about the processing of your personal data (personal data is all data relating to you as a natural person):

We - Rocholz GmbH, Nevigeser Str. 240-242, 42553 Velbert - process personal data relating to you as a contractual partner of your company for the purpose of preparing offers, fulfilling contracts, bookkeeping and cost accounting on the basis of Art. 6 (1) sentence 1 lit. b DSGVO as well as for the fulfilment of contractual and legal obligations (e.g. commercial and tax law) on the basis of Art. 6 (1) sentence 1 lit. c DSGVO. The business relationship exists between us and your company. In the course of external requirements (e.g. in the context of customs/tax law), it may be necessary to compare your personal data with lists published by the authorities.

Furthermore, data is also processed for legitimate purposes according to Art. 6 para. 1 p. 1 lit. f DSGVO, such as marketing, internal market research and marketing purposes, internal company statistics. The legitimate interests lie in particular in the optimisation of processes and cost-appropriate allocation; your interests, fundamental rights and freedoms are duly taken into account here.

If you have given us your consent or if we have informed you appropriately within the scope of data collection in accordance with § 7 UWG (DE) / § 107 TKG (AT), we will use your data to send you information about products, services, events and other interesting information about our company. You can object to this sending at any time with effect for the future.

The data you provide is necessary for the performance of the contractual relationship. Without this data, we cannot fulfil the contract concluded with your company.

Within the scope of the protected area on our website, you can log in using a personal ID. Logs are created and processed for statistical purposes each time you log in. The logs contain the following information:

  • Referrer (page from whose link you arrived at this website),
  • search terms (for search engines as referrer),
  • IP address,
  • browser, operating system, installed plug-ins and screen resolution,
  • time spent on the pages.

The aforementioned data are processed by us on the basis of our legitimate interest pursuant to Art. 6 (1) p. 1 lit. f DSGVO only for the following purposes:

  • Ensuring a smooth connection of the Internet presence,
  • ensuring a comfortable use of our internet presence,
  • evaluation of system security and stability, and
  • for other administrative purposes.

We reserve the right to check this data retrospectively if we become aware of specific indications of unlawful use. The data will be deleted immediately if it is no longer required to achieve the purpose, but at the latest after six months.

Disclosure

Some of your personal data will be passed on to external service providers (e.g. tax advisors, legal advisors). In some cases, external IT service providers may access your data (as part of commissioned data processing pursuant to Article 28 DSGVO). In this case, the service providers act in accordance with instructions, which has been ensured by corresponding contracts. Some of these service providers are located outside the EU/EEA; these service providers ensure an appropriate level of data protection by concluding EU standard contractual clauses.

Retention and deletion of data

Your data will be stored for as long as is necessary for the above-mentioned purposes. The data will be deleted at the latest after termination of the contractual relationship and after expiry of the statutory retention periods under civil, commercial and tax law.

Your rights

We inform you that pursuant to Article 15 et seq. DSGVO, you have the following rights under the conditions defined therein: The right to information about the personal data in question as well as the right to correction or deletion or to restriction of processing or the right to object to processing as well as the right to data portability. You also have the right to lodge a complaint with a data protection supervisory authority in accordance with Article 77 DSGVO. If the processing is based on Article 6(1)(a) of the GDPR or Article 9(2)(a) of the GDPR (consent), you also have the right to withdraw your consent at any time without affecting the lawfulness of the processing carried out on the basis of the consent until the withdrawal.

– Data processing in the context of the application procedure –

We hereby inform you about the processing of your personal data:

We - Rocholz GmbH ; Nevigeser Str. 240-242, 42553 Velbert - process your personal data with regard to your person in connection with the implementation of your application procedure as well as to check your potential job-related employability. In doing so, we process the information you provide for the purpose of making a well-founded personnel decision on the basis of § 26 BDSG and Art. 6 Para. 1 S. 1 I lit. b DSGVO. In addition, evaluations based on objective, non-discriminatory criteria are stored in addition; if this is permissible in individual cases, publicly available personal data about you is also stored in addition.

The data you provide is necessary to carry out the application process. Without this data, we cannot consider your application.

Disclosure / Service provider

In some cases, external IT service providers can access your data. In all cases, the service providers act in accordance with instructions, which has been ensured by corresponding contracts.

We will only pass on your personal data to other companies in our group of companies if you have given us your consent to do so, in order to provide you with further entry options in our group of companies.

Retention and deletion of data

Your data will be stored for as long as is necessary for the above-mentioned purposes of the personnel selection procedure. If you object to data processing during the personnel selection procedure, the data will be deleted - unless otherwise required by law.

The data will then be deleted after the end of the application procedure and after the expiry of any action periods, unless you have given your consent to save your application for further job offers. Unsolicited applications are stored for a maximum of up to two years or until you revoke your consent and are then deleted.

Your rights

We inform you that pursuant to Article 15 et seq.
